John McCain describes Barack Obama as being part of the “Pro-Abortion Movement.” Yet, Obama has never been a part of any movement concerning abortion. He has however, along with so many others, has advocated such things as education, health programs, prevention, and more acceptance toward adoption. His primary concern is to reduce the number of abortions being pereformed, which is contrary to what McCain is asserting. Obama offers to work with people of all political and personal views.

What do McCain and Palin propose to do? McCain says government isn’t the answer, but he supports government intruding into the private lives of women. He makes fun of the “health of the mother exception” in laws governing late-term abortions. He also voted against the Violence Against Women Act, championed by Joe Biden, and supported by Democrats and Republicans, including President Bush. This leads to another issue concerning abortions; victims of rape.

Palin, mayor of Wasilla, made victims of sexual assault pay for rape kits and personal believes that a rape victim should not have the right to get an abortion if the victim were to become pregnant as a result of the rape. If you don’t want a return to the days when “coat hangers” represented a choice for desperate women, if you want fewer abortions in this country, and if you want to protect victims of domestic violence, if you want rape victims to have the same Roe vs. Wade rights that afforded women the right to chose, then you need to support Barack Obama and Joe Biden. Otherwise, the metal coat hanger industry will see a boost of sales if Palin managed to get in the White House as VP and then be given an opportunitity to actually be President. Now this is a scary, scary thought.

Patriarchal Societies Promote Women’s Rights’ Abuses

Today’s world differentiates a lot from what it was 50 years ago. It has transformed; sometimes for the better and sometimes for worse. Places have changed and with them their people have too. In general, today’s people have more acceptance and tolerance towards one and other and are open to experiencing cultures different from their own. The Human Rights have developed and are practiced across the globe, distinguishing what is humane from what is intolerable. Unification is seen amongst countries which are willing to aid each other hence 192 countries are members of the UN with the hope of making the world a safer and healthier place for all. Over the past few decades many countries have been concentrating on maintaining equity within their people whether it’s regarding wealth between the rich and poor or equal rights between both sexes. The notion that men are the superior sex has been long forgotten for many communities. Although many countries no longer have problems between men and women, patriarchal societies still exist and it is these societies that promote women’s rights’ abuses.

Patriarchal societies consist of Third World Countries, some from the Middle East but mostly from South East Asia and Africa. Generally these countries refuse to rid themselves of ancient traditions and culture not realizing that many of these traditions must be discarded since they are unjust. For example in India where the ritual of dowries lives on and continues to cause hassle, to the extent that the largest jail of the capital has a separated quarter for mother-in-laws who murdered or abused their sons’ wives. Presently it is ‘home to roughly 120 women, some of whom are serving 20-year sentences for murdering their daughters-in-law’ (Lavin, 2006). Indians have clasped their dowry tradition for over hundreds of years although The Dowry Prohibition Act was released back in 1961 (Lavin, 2006), it fails to fulfill its purpose and so it is looked upon as a “paper tiger” (Lavin, 2006). It is said that ‘every 77minutes a dowry death is reported’ (Lavin, 2006) and in the year 2005 7,026 reported dowry deaths occurred. It is difficult to believe that a country progressing at the rate of India still stomachs such barbaric behavior that is happening in masses. One of the reasons dowries are considered so important is because of the notion that girls are burdens to their families. Girls are not expected to work in most patriarchal societies thus when a husband takes the daughter away from a family he is doing a favor for them by releasing them from one of their burdens therefore he should be rewarded with an adequate dowry. The idea of men being the provider of the family is a primeval one since it originated in the times when men were in fact the better option for providing for the family being the physically stronger sex however this is no longer essential to successfully handle a household. A regular job accompanied with a decent wage is enough to make a woman capable of providing for herself and family. If women were encouraged to work they would never be considered a burden nor would they depend on a man for financial security. Other than limiting women from leading their own lives and forcing themselves into marriage, many patriarchal societies’ households further seize the protection and rights of women even after marriage. A sufficient amount of domestic abuse takes place in numerous Indian households, including marital rape and emotional abuse (Lavin, 2006). If women were able to support themselves they would not be forced into staying in abusive relationships. According to the book titled “Women’s Roles and statuses-The World Over” in the year of 2000, ‘the ratio of female to male enrollment in secondary school was 83 women to every 100 men’ however the number of women in post secondary schools drop significantly in comparison with only 37 women to every 100 men (Hepburn & Simon, 2007). Education and work would free many Third World women from physical and emotional abuse, girls would not be looked upon as burdens and this would lead to a decline in cases of abuse and issues such as female infanticide. Female Infanticide is most common in patriarchal societies. It is most prominent in India and China, where the number of deaths of girls shortly after birth, continues to increase (Female Infanticide). Parents prefer to have sons over daughters since daughters weigh down parents and are also more capable of dishonoring a family. Men are believed to be the ones that will ensure the family by earning money whilst women are considered the source of economic drainage for a household. Women are not only loathed due to their incapability of being profitable when it comes to bringing money home, they also become the object of abuse and murder when they fail to carry the honor of a man whether it is their father, brother or husband, lucratively. ‘Honor Killings’ is a crime that most people in developed countries would have never heard of but unfortunately these crimes are still very common in patriarchal societies. ‘Honor killings’ is the name given to the murder of a woman who was killed by family members because she had brought shame to them in some way, (Khalaf Al-Ajely, 2005). In countries such as Iraq, ‘honor killings are an accepted practice’ and usually are not reported, (Khalaf Al-Ajely, 2005). Reasons for ‘honor killings’ differ, from refusing to marry a man of the family’s choice, to marrying someone of her own choice, to being raped. The fact that an innocent woman could be murdered by her own family members for being raped by a perverted chauvinist is extremely overwhelming. Since the fall of the Saddam regime, ‘more than 400 women have been raped’ and ‘more than half of them have been murdered in honor killings’ (Khalaf Al-Ajely, 2005). Although ‘honor killings’ are equivalent to murder, culprits are treated differently despite of what authorizes say. One of the many women murdered in ‘honor killings’ in Iraq was Shawbo Rauf Ali, a 19 year old who was accused of being involved in an extra marital affair by her husband, who made this assumption based on a sole ‘unknown number that appeared on her cell phone’ (Salih, 2007). Hawjin Hama Rashid, a Women’s Rights activist in Iraq stated that ‘honor has been a prime motivator of violence against women, because in such a patriarchal society women are considered the honor of their men’, (Salih, 2007).

Some would argue that just because a society is patriarchal it does not mean that it abuses women rights. Many women are content living in their male dominated environment. They believe that their position is below their counterparts. For many the entire purpose of living is to care for their husband and his family. A number of Muslim states are accused by the West of depriving their women of their rights and for a handful of these states, this could be true. The women in these states appear satisfied since they believe that they are truly following their religion.

Many believe that gender equality and Islamic law are two conflicting issues. According to the West, Islam is unjust to women with its attitude towards ‘polygamy, divorce, child custody, inheritance and women as witnesses’ (Mashour, 2005). However, Islam does not support injustice to women at all. It was the first religion to give women the rights to inherit from their fathers and also gives them the right to choose their husbands (Mashour, 2005). A man’s right to keep up to four wives at a time is misused by many Muslim men today, (Mashour, 2005) since there is a specific criteria to when a man could marry more than once in the Holy Qur’an. Many Muslim men find it acceptable to assault a women who dishonored them but nowhere does it say in the Qur’an that it is acceptable to take a life of a girl by the name of ‘honor crimes’, (Mashour, 2005). In the cases of Islamic States, culture is confused with religion to such an extent that people justify ‘honor killings’ by saying it is required in Islam. Women do not hesitate in following ‘Islamic’ ways since they feel that they are sacred, unaware that it is just cultural and not religious at all, ‘deterioration of women’s rights in many Islamic countries has nothing to do with their Islamic nature and that most of the gender inequalities are not based on Islam but are mainly the result of traditional, patriarchal, male dominated societies’, (Mashour, 2005) It’s true that many women do not complain of their situation from these countries but this is because they are functioned to adjust and compromise for their own well being. The girls who’s lives are not snatched from them as infants, are brought up to believe that their purpose of living is to cater and care for their future husbands and families regardless of how they are treated. So when they are abused girls are willing to bare the pain. Women in these countries do not have strong organizations that they could turn to when in need of help. Even the police are not willing to offer any assistance since such abuses are considered ‘normal’ in such societies. Not only is it difficult for women to find help, it is also difficult for them to just free themselves of such relationships. Divorce is unsupported by many families as it is looked down upon on. Divorcee girls have a hard time trying to get remarried plus the fact they will probably not be able to support themselves financially leaves them less motivated about separation.

Ultimately, the main cause of the women’s rights abuse in patriarchal societies is the lack of education. Educated women will be aware of what is right and what is wrong, they would be aware of the help that is available for them and options other than putting up with abuse and most importantly they would be aware of their rights. They would be able to differentiate religion from culture and tradition. Also women need to realize that their position in society is equal to that of the men in their society not below them. Patriarchal societies which are mostly conservative limit their women of reaching their full potential firstly by limiting their education and secondly by enforcing cultural baggage on them which only holds them down.

As a result of the first bill signed by President Obama, women finally have a much greater chance of receiving pay that is equal to what men receive for the same work from an employer. However, it is still likely to require the filing of numerous lawsuits before employers come to grips with the fact that they can no longer get away with paying less money to women.

On January 29, 2009, President Obama signed into law, the Lilly Ledbetter Fair Pay Act of 2009, the first bill signed into law by the President paving the way for these lawsuits to require that equal pay be given to women, by way of seeking back pay awards for the difference they were paid and what men were paid for the same work.

If you have been discriminated against in your employment in California by receiving less pay for the same work performed by persons of the other gender, even though the statute of limitations has been extended by this Act, you still need to speak with a women’s rights lawyer or an employment attorney as soon as possible.

If you are a woman and you’ve been receiving less pay than men are receiving for the same work from the same employer, visit our website at http://www.sebastiangibsonlaw.com and call us at any of the numbers easily found on our website.

Prior to the Act becoming law, as a result of a Supreme Court ruling, women were required to file suit within 180 days after first being paid unfairly, even if the discrimination of being paid less than male workers in the same jobs continued.

And if a woman failed to discover that male workers were being paid more for the same work, a woman still could not hold her employer accountable if she didn’t learn of the unfairness and take action within 180 days of first being paid the lesser rate.

Under the Fair Pay Act of 2009 signed into law by President Obama, the statute of limitations of 180 days starts with each discriminatory paycheck, rather than when the employer starts to discriminate. So long as a woman in CA files her claim within 180 days of receiving any discriminatory paycheck, not just the first one, she is considered timely in bringing her claim.

An important aspect of the Act is that the effective date of the Act is retroactively set at May 28, 2007, which will allow it to apply to all compensation discrimination claims that have been filed on or after that date.

Women can sue for back pay awards for up to two years before she files her employment discrimination claim under Title VII of the Civil Rights Act of 1964. The Fair Pay Act of 2009 does not change the two-year back pay limit.

The Fair Pay Act is a major victory for women in California who have long been discriminated against in the pay they receive for the same work that men perform and are paid substantially more in many places. It has been determined that women have been earning only 77 cents for every dollar a man earns. This Act will likely go a long way in addressing that unfairness, although it will likely require a good many lawsuits to hammer this home to employers who discriminate against women in their pay guidelines.

With the signing of this Act into law, initial victories in CA against an employer will likely lead to settlement of other lawsuits for co-employees who have been discriminated against in the same manner by the same employer.

Those who would say that the Act will lead to the employment of less women in such positions by employers fearful of such lawsuits simply don’t understand the anti-discrimination laws in this country and the greater risk employers would be taking if they adopted such a discriminatory stance in their hiring practices.

Even with the retroactive effect of the Act, employers in California may be slow to increase the salaries and hourly rates of their women employees until lawsuits begin to fly. Employers who have previously gotten away with discriminating against women in CA may only react in more numbers when they begin to feel the full weight of the law themselves or see large judgements against other employers who have discriminated against women.

The votes in favor of the bill in the Senate included every Democratic senator except Senator Edward Kennedy who was absent because of his health, and all four Republican women senators. Every Republican male senator except Arlen Spector voted against it. If that won’t come back to haunt the Republicans in the next election, it is hard to imagine what else they will do to alienate themselves more from the women’s vote.

Under the Act, an unlawful practice occurs when a discriminatory compensation decision or other practice is adopted, when a person becomes subject to the decision or practice, or when a person is affected by the decision or practice, including each time wages, benefits or other compensation is paid.

For the first time in our nation’s history, we have an impassioned feminist at the helm of United States Foreign Policy. Her name is Hillary Rodham Clinton.

Following her confirmation hearing for the post of Secretary of State, Clinton’s thoughtful and comprehensive approach to global conflict resolution is already being hailed as ”Smart Power”. That comes as no surprise to those who have been following this superwoman’s career and have long admired her brilliance.

Hillary Clinton doesn’t just have a head for leadership, she has the heart for it, too. In describing her approach to foreign policy, she is inspired by the ancient Roman poet Terence who, though born a slave, rose to become one of the great voices of his time. He said, “In every endeavor, the seemly course for wise men is to try persuasion first”. Hillary reflected, “The same truth binds wise women as well”.

While some foreign policy conflicts might be open to negotiation, Hillary’s view of the crimes against women around the world is uncompromising. Unlike predecessors who might have delicately avoided or even accommodated such traditions as ones we should not presume to judge, Hillary’s condemnation is bold and clear. She decries the practice of acid burnings in Pakistan and the punishment of women for divorce. She promises that under her watch, The Office of Human Trafficking and the Women’s Office will have a place of special emphasis and the mistreatment of women will not be relegated to “auxiliary” status in her State Department.

She said of the Taliban fighters who targeted girls for attending school: “This is not a culture. This is not a custom. This is criminal.” She denounces those who commit the atrocities and says “They want to maintain an attitude that keeps women unhealthy, unfed, uneducated.” Clinton says their actions ”result all too often in violence against these young women.”

Hillary Clinton vows that protecting women and their human rights will not be an adjunct, but central to her foreign policy. As Secretary of State, she hopes to persuade other governments that “we cannot have a free, prosperous, peaceful, progressive world if women are treated in such a discriminatory and violent way”. She embraces it as a ”pledge” and considers it a matter of national security.

In 1995 in China, Hillary Clinton said the famous words, “Women’s Rights are Human Rights”. Now, as Secretary of State, she will be able to make her vision of a better world for women part of America’s 21st Century global initiative.

“Our foreign policy must reflect our deep commitment to the cause of making human rights a reality for millions of oppressed people around the world. Of particular concern to me is the plight of women and girls, who comprise the majority of the world’s unhealthy, unschooled, unfed, and unpaid. If half of the world’s population remains vulnerable to economic, political, legal, and social marginalization, our hope of advancing democracy and prosperity will remain in serious jeopardy. We still have a long way to go, and the United States must remain an unambiguous and unequivocal voice in support of women’s rights in every country, every region, on every continent.”

A thought occurred to me after reading the article “The other side of it” in yesterday’s paper, it was how hard women have to try even to be considered equal and then have society slapping them in the face for it. Why does a woman have to justify herself when she even compares herself to a man? This question has dogged me to no end and the worst part is other women criticise them too. When a man puts his career ahead of his family no questions are asked as he is termed to be focussed in life and when a woman does it she is considered negligent. To support this argument of course Indian Culture is used as we Indians have this strong cultural fabric which separates us from the rest of the world (read the west). Give it a rest already; the claim over moral superiority is a farce to say the least.

The first question that comes to mind is that who defined these roles to specific genders? We respect our women so we deny them rights and independence and keep them locked up in our houses to take care of the children and wash clothes, Is that not what women are supposed to do in the first place? Why don’t women have an equal right to do in life as they choose without the burden of society on their society like most men enjoy currently. Granted that the most important person in a child’s life is his/her mother but why can’t fathers take equal responsibility of the children or share household chores. What is so unholy or wrong in that, it surely is not a crime to do that but for women to think that way is I suppose.

Women are being taught to be independent and made to believe that they are the better sex, which is such a juvenile thought in itself. We still live in a society where a male child is more celebrated, dowry still exists, domestic violence is rampant and thanks to sonograms there are lesser women compared to men. I do not see anybody objecting to that side because it is sadly an accepted fact. A woman has to try so hard to be respected in what were considered to be exclusively male domains, why if it were not for a few brave women who faced and braved being socially ostracised then women would not have had the courage to go to schools and universities, having an education was also an act of defiance. After watching a few television commercials and shows there is a consensus that women are forgetting family values and their children. Have there been any fathers around who have been accused of that anytime of their lives? Daddy is the one who is supposed to work while mummy cooks and cleans at home, God forbid that situation changes even if it is only a very minute percent of people being represented there.

Role reversal, what kind of role reversal has there been? Men still control most of society and most laws are made to favour men (apart form the complaints made about unfair laws such as the domestic violence and prevention of dowry). Women are subject to such a huge amount of scrutiny when they even think of wavering from the path induced by generations of male dominance. Women are not the better sex but they have to do everything better and work a lot harder even to get noticed. Whenever anything is spoken in support of women there are exceptions quoted to the contrary, well there are exceptions quoted even for murder cases so do few examples change the nature of taking somebody’s life? For every Indira Nooyi there are thousands of women who encounter the glass ceiling. So when one woman has a man doing household chores all women are blamed for being insolent and forgetting their values.

That sounds very hypocritical as men are not subject to half the criticism women get for trying to change things, is it so wrong to expect fathers to be an equal part of a child’s life as their mother? Women are trusted to keep a family together, a woman makes a home what it is, it is a woman’s job to make a house a home. Why can’t men help in making that house a home as well? The fact is women are far from equal even in today’s world, lot of men and women will disagree with that and again quite exceptions, which may be counted on fingertips. Does that not say a lot about the so many other women and girls who still face problems when they want to exercise their independence? Boys are still preferred to girls, still get priority when it comes to education, do not have to get married before 25 or 26 and are not questioned about spending more time working than with family. Until there is equal sharing of the load and women are given equal right and not just in theory but practically, there have to be exceptions to the rule to inspire women to get to that status. The attitude, arrogance and insolence are just an urban legend till that day arrives. Let them be equal then complain about the problems associated with that.
